To qualify for EB-2 immigrant visa, foreign nationals must meet the following requirements:

  • Candidates must be able to demonstrate evidence that their college or university degree was earned and is pertinent to their area of expertise and exceptional ability;
  • Candidates must be able to demonstrate that they have at least 10 years of full-time work experience within their area of exceptional ability;
  • In most cases, candidates must obtain a job offer from a U.S.-based employer in combination with labor certification approved by the U.S. Department of Labor. In order for a labor certification to be approved, the U.S. employer must be able to demonstrate that the company has completed a process of recruitment for the position a foreign national will be filling, but was unable to find a U.S. worker who met minimum requirements for the vacancy. Moreover, the salary offered to a foreign alien must meet the U.S. Department of Labor prevailing wage standards;
  • Candidates should also provide evidence demonstrating their memberships in professional associations; proof of national and international recognition for their achievements in their field of expertise; lastly, candidates should be able to demonstrate that they were compensated for their work and services within the area of their expertise.
