EMPLOYMENT FIRST PREFERENCE (EB-1)
Priority Workers
First-preference employees can be subdivided into three categories:
Workers of extraordinary ability in the sciences, arts, education, business, or athletics:
- To be considered a worker of extraordinary abilities within this subcategory, a foreign national must have accomplished publicly recognized achievements and have attained international acclaim.
- We should point out that foreign nationals who are able to demonstrate that they will be working in their field of expertise while in the United States do not need to obtain a job offer from a U.S. employer.
Outstanding university professors and researchers:
- Professors and researchers who have attained international acclaim and recognition in a particular academic field and who have at least three years of professional experience within this field may qualify for EB-1 immigrant visa once they have secured a position at a U.S. institution of higher education or a research organization.
Transferring executives or managers of multinational companies:
- Executives and managers who have been employed by a foreign parent company for at least one consecutive year out of the past three years and who are going to take an executive or managerial position at a U.S. subsidiary, branch or affiliation may qualify for EB-1 status if they can meet a list of requirements set by USCIS.
